Shiseido Beauty Diagnosis Lab Terms of Use
These Terms of Use set forth the rules for using the various services provided by the Shiseido Beauty Diagnosis Lab, which is operated by Shiseido Company, Limited.
■Article 1 (Application of Terms)
These Shiseido Beauty Diagnosis Lab Terms of Use (hereinafter referred to as "these Terms") shall apply to all users of the various services related to the Shiseido Beauty Diagnosis Lab (hereinafter referred to as the "Service") operated by Shiseido Company, Limited (hereinafter referred to as "Shiseido").
■Article 2 (Compliance with Terms)
The customer shall use the Service in accordance with these Terms and other rules stipulated separately by Shiseido, including the various terms of use for the Service.
■Article 3 (Amendment of Terms)
Shiseido may amend all or a part of these Terms when there are any changes to the Service or any amendments to applicable laws and regulations, or if Shiseido otherwise deems it necessary. In such cases, Shiseido shall post the amended Terms and the revision history on the Shiseido Beauty Diagnosis Lab My Page as stipulated in Article 4. The amended Terms shall take effect five business days after the date of posting, unless otherwise specified in the aforementioned notice.
Notwithstanding the preceding paragraph, if Shiseido requests the customer's consent to the amended Terms and the customer agrees to them, the effective date of the amendment shall be the date of the customer's consent.
■Article 4 (Shiseido Beauty Diagnosis Lab My Page)
Any person who wishes to apply for the Service shall agree to these Terms and register for the Shiseido Beauty Diagnosis Lab My Page (hereinafter referred to as "My Page"). The registration procedure shall be performed solely by the individual in person, and proxy registration is strictly prohibited.
Registration shall be completed when Shiseido accepts the registration procedure performed by the customer as described in the preceding paragraph. Shiseido may choose not to accept the customer's application or may revoke its acceptance even after having accepted it, if any of the following items apply. Shiseido shall determine whether any of the following items apply at its sole discretion:
The customer has provided false information.
The customer falls under Article 8 (Prohibited Matters).
It is discovered that the customer has previously had the provision of the Service or reservations canceled because of a violation of these Terms.
The customer applies using an email address that is not in their own name.
The customer applies on behalf of a third party.
The applicant is a minor who has not obtained parental consent (A minor who applies will be deemed to have obtained parental consent).
The applicant is a corporation.
Shiseido otherwise deems the customer inappropriate.
■Article 5 (Acquisition and Handling of Personal Information)
Shiseido shall acquire the personal information listed in the following items from the customer who uses the Service. Additionally, the customer agrees to provide the personal information listed in the following items when using the Service:
Name
Date of Birth
Gender
Phone Number
Postal Code
Address
Email Address
Usage history of the Service
Measurement results obtained through the Service
Shiseido shall, on an as-needed basis, acquire the information stipulated in the preceding items and other personal information that the customer enters or provides through the applicable application or applicable website when using the Service.
Shiseido shall appropriately manage the customer’s personal information in accordance with the Act on the Protection of Personal Information and Shiseido’s Privacy Policy (https://corp.shiseido.com/en/privacy-policy/).
The purposes for which Shiseido acquires and uses the customer's personal information are as follows:
For customer identity verification, confirmation of application details, creation of Service results, and providing the customer with optimal information based on measurement results.
For analysis, and the creation of related materials based on the analysis results.
For the planning, research, development, advertising, introduction, and marketing of cosmetics, food products, and beauty-related services using the aforementioned analysis results and materials.
For inclusion in the training materials used in the various training programs.
For use in public relations activities, including inclusion in company brochures, business reports, company history materials, and other related activities.
For communicating the Service results to the customer, conducting counseling sessions, and responding to inquiries or complaints from the customer.
For the investigation, prevention, and response to fraudulent activities, such as scams and unauthorized access using the Service, including the use of identity verification services.
For communicating other necessary matters.
■Article 6 (Acquisition, Use and Provision of Personally Related Information)
Shiseido shall acquire personally related information—which, on its own, does not constitute personal information—including attribute information (age, gender, region of residence, etc.) and log information related to Internet use (IP addresses, MAC addresses, SSID, Cookies, RDID and other device identifiers, Web beacons, etc.) when the customer uses My Page. Shiseido shall utilize this information for the same purposes as the purposes of use of personal information stipulated in Article 5, Paragraph 4, as well as the following purposes: Furthermore, in utilizing the acquired personally related information, Shiseido may cross-reference it with the personal data held by Shiseido.
To temporarily store necessary information to allow for more convenient browsing of the applicable website, especially when applications span multiple pages of the site.
To provide services customized for each user by referencing stored registration information when the user is logged into an authentication service.
For the purpose of collecting statistics on the users’ usage status of the Service and analyzing user access trends by Shiseido or by a company commissioned by Shiseido to conduct research and analysis.
For the purpose of providing the most appropriate advertisements based on the user's usage status.
For the purpose of prompting users to re-enter (re-authenticate) their password after a certain period of inactivity to maintain security.
Shiseido shall receive personally related information from its Japanese and overseas subsidiaries and affiliates, as well as contractors and partners, such as DMP operators, other advertising companies, research/analysis companies, media operators, and database management companies. Shiseido shall utilize this information for the same purposes as the purposes of use of personal information stipulated in the items of Article 5, Paragraph 4, as well as the purposes stipulated in the items of Paragraph 1 of this article. Furthermore, in utilizing the provided personally related information, Shiseido may cross-reference it with the personal data held by Shiseido.
Shiseido shall provide the user's personally related information to its Japanese and overseas subsidiaries and affiliates, as well as contractors and partners, such as DMP operators, other advertising companies, research/analysis companies, media operators, and database management companies.
■Article 7 (Prohibition of Assignment of Rights)
The customer is prohibited from assigning, leasing, or otherwise offering as security any or all of their status, rights, or obligations related to the use of the Service to a third party.
■Article 8 (Prohibited Matters)
Shiseido prohibits customers from engaging in the following actions when using the Service. The determination of whether an action falls under any of the following items shall be made solely at Shiseido's discretion:
Altering reservation details using a false name, gender, date of birth, or an email address, phone number, or other information that does not belong to the user.
Acts that libel, slander, or damage the reputation of other users, third parties, or Shiseido (including Shiseido employees), or acts that may lead to such outcomes.
Acts that infringe the property rights or privacy of other users, third parties, or Shiseido (including Shiseido employees), or acts that infringe intellectual property rights (including copyrights, design rights, patent rights, utility model rights, trademark rights, and portrait rights), or acts that may lead to such infringement.
Transmitting or posting harmful computer programs or similar items.
Posting or sending spam messages (acts by one or more users of posting or sending the same or similar text to available sections within the Service or via message), spam words (acts by one or more users of posting multiple terms irrelevant or only slightly related to the section, or extremely long sentences or a large quantity of terms in available sections within the Service), or spam URLs (acts by one or more users of posting or sending the same URL to available sections within the Service or via message, and this includes any other acts deemed as spam by Shiseido).
Acts contrary to public order and morals, criminal acts, or acts that may lead to such outcomes.
Repeatedly canceling reservations immediately before the reserved date for the Service or failing to attend without notice.
Acts that violate the rules of the networks being traversed when communicating via other Japanese or international networks.
Acts that place an excessive burden on Shiseido's servers or acts that cause disruptions to the Service's network system.
Using the Service for commercial purposes or for preparing to do so.
Election campaigning or similar activities, or any other acts related to politics or religion.
Acts that violate the cautionary notes for the Service.
Any other acts that impede the operation of the Service.
Any other acts that violate laws and regulations or acts that may lead to such violations.
Acts that affect the smooth provision of the Service, such as moving or leaving the session without permission from Shiseido staff during the Service or acts that obstruct other users.
Unauthorized recording or photography during measurement or treatment sessions in the Service.
If Shiseido determines that a customer’s conduct falls under any of the items listed in the preceding paragraph, Shiseido may restrict or refuse provision of the Service and may cancel any reservations. In such cases, Shiseido shall bear no responsibility whatsoever for any disadvantage or damage incurred by the customer.
■Article 9 (Deletion of Information Provided by Customers)
If the information, text, and drawings (hereinafter collectively referred to as "Information etc.") provided by the customer falls under the prohibited matters of Article 8, Shiseido may, at its discretion and without prior notice to the customer, delete the Information etc. In such a case, Shiseido shall not be obligated to disclose the reason for the deletion. The customer shall bear all legal liabilities arising from such deletion, and Shiseido shall bear no responsibility whatsoever.
■Article 10 (Copyright and Other Intellectual Property Rights)
All rights related to the content posted on the website pages pertaining to the Shiseido Beauty Diagnosis Lab, including My Page, shall belong to Shiseido or be used by Shiseido based on licenses or other just title. Shiseido prohibits the customer from utilizing any content posted on My Page, or Shiseido's responses to the customer's inquiries for any purpose other than the customer's personal use or from re-providing them to the public, both inside and outside the network, or from unauthorized use or reproduction.
All trademarks and service marks appearing on the website pages pertaining to the Shiseido Beauty Diagnosis Lab, including My Page, shall be owned by Shiseido or its subsidiaries or affiliates or be used based on licenses or other just title. Shiseido prohibits the customer from using these without authorization. In the event that copyright (including the rights stipulated in Articles 27 and 28 of the Copyright Act) or other intellectual property rights arise regarding the Information etc. provided by the customer, the customer shall transfer the rights pertaining to the Information etc. to Shiseido free of charge and shall not exercise the moral rights of authors or similar rights.
■Article 11 (Damages)
The customer shall be responsible for the use of the Service and the results thereof. If the customer causes damage to another user or a third party for reasons attributable to the customer regarding the use of the Service, the customer shall resolve the issue at their own responsibility and expense.
If the customer causes damage to Shiseido for reasons attributable to the customer regarding the use of the Service, the customer shall compensate Shiseido for the damages incurred.
■Article 12 (Disclaimer)
Shiseido shall bear no responsibility whatsoever for damages arising from the use of the Service or the use of Information etc. provided through the Service and shall not be obligated to compensate for any damages.
Shiseido shall bear no responsibility whatsoever for damages arising from the use of websites managed and operated by third parties to which My Page links and shall not be obligated to compensate for any damages.
Shiseido shall not be liable for any damage incurred by the customer in connection with the Service, including interruption, delay, discontinuation, or loss of data due to faults in communication lines or computers, or alteration/damage caused by unauthorized access to data.
Shiseido shall not be liable for any loss or damage to data, delay or inability to provide the Shiseido Beauty Diagnosis Lab Service, or cancellation of reservations due to Shiseido's decisions resulting from the reasons in the following items:
Natural disasters, such as earthquakes, tsunamis, storm surges, floods, winds and rainstorms, landslides, collapses, and other calamities.
The spread of large-scale infectious diseases or similar events.
Strikes or sabotage.
Social unrest, such as war, terrorism, or civil commotion, and other similar incidents.
Accidents resulting from the radioactive, explosive, or otherwise harmful properties of nuclear fuel materials, or social confusion caused by such properties.
Fires caused by force majeure.
Unforeseen abnormal traffic disruptions.
Suspension, unsealing, confiscation, seizure, or delivery to a third party of transport due to laws and regulations or the exercise of public authority.
Shiseido shall bear no responsibility whatsoever for any disputes that arise from the use of the Service between customers, between a customer and an Information etc. provider in the Service, or between a customer and a third party.
Shiseido shall bear no responsibility whatsoever for the abolition of the Service.
If Shiseido confirms, through the prescribed method on My Page, that the combination of the login ID and password used matches the registered credentials and deems that the credentials were used by the customer, Shiseido shall not be liable for any damages resulting therefrom, even if a third party other than the customer is using the credentials because of theft, fraudulent use, or other circumstances.
Shiseido shall not be liable for any damages resulting from the customer's failure to register changes to their registration information in a timely manner on My Page.
The provisions of this article shall not apply if Shiseido has acted with willful misconduct or gross negligence. Even in cases where Shiseido is liable under this paragraph, Shiseido shall not be liable to compensate the customer for any damages related to incidental damages, indirect damages, special damages, future damages, and lost profits.
■Article 13 (Suspension of the Service)
In order to maintain the Service in good operating condition, Shiseido may suspend all or part of the provision of the Service without prior notice to the customer in the following cases. Shiseido shall not be liable for any damages or disadvantages incurred by the customer due to such suspension of the Service.
In the case of scheduled or emergency maintenance of the system that provides the Service.
If a malfunction or failure occurs in the system that provides the Service.
If the provision of the Service becomes difficult because of force majeure, such as fire, power outages, and earthquakes or due to acts of disruption by a third party.
If Shiseido otherwise determines that there is a reasonable cause.
■Article 14 (Termination or Discontinuation of the Service)
The customer acknowledges and agrees in advance that Shiseido may terminate or discontinue the Service, in whole or in part, without prior notice to the customer.
Shiseido shall bear no responsibility whatsoever for any disadvantages or damages incurred by the customer as a result of the termination or discontinuation of the Service.
■Article 15 (Withdrawal of Consent)
If the customer wishes to withdraw consent to these Terms, they must complete the withdrawal procedure on My Page. After withdrawal, the customer will no longer be able to view their Service results on their My Page.
The withdrawal procedure based on the preceding paragraph is separate from the withdrawal of consent to the Research Cooperation Terms. If the customer wishes to withdraw consent to the Research Cooperation Terms, they must follow the procedures stipulated in those terms.
■Article 16 (Governing Law and Jurisdiction)
The interpretation and application of these Terms shall be governed by the laws of Japan. Furthermore, all disputes related to My Page and the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, unless otherwise stipulated.
